Welcome to OpenAura. These Terms of Service ("Terms") govern your access to and use of the OpenAura application, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
By creating an account or using the Service, you confirm that you are at least 17 years of age and have the legal capacity to enter into these Terms. If you do not agree to these Terms, you may not use the Service.
OpenAura is a platform that enables users to have conversations with AI-powered personalities created by content creators ("Creators"). The AI personalities are designed to reflect the Creator's voice, knowledge, and personality, but are not real-time communications with the Creators themselves.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep your account information up to date.
You agree not to use the Service to:
Certain features of the Service may require payment. All payments are processed through our third-party payment provider (Stripe). You agree to pay all fees associated with your use of paid features. All payments are non-refundable unless required by applicable law.
Creators retain ownership of the content and personality data they provide to create their AI personalities. By using the Service, Creators grant OpenAura a license to use this content solely for the purpose of operating the Service.
The Service, including its design, text, graphics, logos, and software, is owned by OpenAura and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
Responses generated by AI personalities on OpenAura are created by artificial intelligence and do not constitute real-time communications with Creators. While AI personalities are designed to reflect Creator input, responses may not always be accurate, complete, or representative of the Creator's current views. OpenAura is not responsible for the accuracy of AI-generated content.
To the fullest extent permitted by law, OpenAura shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid to us in the preceding 12 months.
We reserve the right to suspend or terminate your account at any time, with or without cause, with or without notice. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.
We may modify these Terms at any time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OpenAura is incorporated, without regard to conflict of law principles.
